Terms of service

These terms apply when you book PHILOMERAX (Philomerax LLC, Atlanta, Georgia) through philomerax.com. By holding a deposit or requesting a discovery call, you agree to them. Questions: [email protected].

Booking and deposits

• Spot and Feature packages are booked with a 50% deposit. When you request a date, the deposit is held on your card, not charged.
• We confirm or offer another date within 24 hours. The deposit is charged only when your date is confirmed. If we can't take the booking, the hold is released and you're never charged.
• Card holds last about 7 days. If a date isn't agreed in that time, the hold expires and you can book again.
• A date is only reserved for you once it's confirmed. A "Limited" day on our calendar already has another request waiting, so it isn't guaranteed.
• The remaining balance is due on delivery.

Cancellation and refunds

• If you cancel more than 5 days before your shoot, your deposit is refunded in full.
• If you cancel within 5 days of your shoot, the deposit is kept to cover the reserved day.
• If we have to cancel at any point before your shoot is completed, your deposit is refunded in full.
• To move your date, email us. If we agree a new date more than 5 days before the original shoot, your deposit carries over.
• Weather: most camera gear can't be used in the rain unless rain protection is planned ahead of time, and even then we'll usually reschedule. If rain or unsafe conditions stop a shoot, we'll reschedule at no charge.
• Refunds go back to the original card and usually arrive within 5 to 10 business days.

Retainers and custom work

Retainers and Campaign projects start with a free discovery call. Scope, price and billing are agreed in writing before work starts. Retainers have a 3-month minimum and are billed monthly.

The shoot and delivery

• Session length, locations and deliverables are as listed for your package. Time beyond the session is billed as overtime at the rate shown on our pricing page.
• Each project includes 2 rounds of revisions. Extra rounds can be added.
• You're responsible for access to locations, vehicles and people you ask us to film, including any permits or permissions.

Using your content

Once paid in full, you can use the delivered photos and videos to promote your business on any channel. PHILOMERAX keeps the copyright and may show the work in our portfolio and on our social media, unless we agree otherwise in writing. Licensed music or third-party material may come with its own limits, which we'll tell you about.

Liability

We take great care with every shoot. If something goes wrong on our side, our total liability is limited to the amount you paid for that project. We aren't liable for indirect losses such as lost profits.

General

These terms are governed by the laws of Georgia, USA. If any part is found unenforceable, the rest still applies. We may update these terms; the version on this page when you book is the one that applies to your booking.
